Third defense verdict in two weeks for PM USA
A Miami-Dade jury today ruled in favor of Philip Morris USA Inc. in an Engle case ( Frazier v. Philip Morris USA, producer of Marlboro cigarettes and RJ Reynolds, manufacturer of Camel cigarettes ). Philip Morris Wins Round In Florida Tobacco Battle
Tobacco giant Philip Morris USA, manufacturer of Marlboro cigarettes has won another victory as it defends itself against lawsuits filed by former smokers. On Friday, a Miami-Dade County jury ruled in favor of Philip Morris in the litigation that grew from the decertification of the so-called Engle class action lawsuit. In 2006, the Florida Supreme Court decertified the Engle class action lawsuit against Big Tobacco, which culled together thousands of cases filed around the state. In that ruling, the high court said the factual findings made by the jury in the Engle class action could be used in future cases heard in Florida. Philip Morris refused the deal with Columbia
Philip Morris International Inc (PM.N) said on Tuesday that its proposed $452 million acquisition of a Colombian cigarette manufacturer did not get approved by the country’s competition authority.The maker of Marlboro cigarettes said it will seek reconsideration of the initial decision of the Superintendent of Industry and Commerce. “We are obviously disappointed with this initial decision but the process is continuing and PMI is committed to working with the SIC to address its concerns,” James Mortensen, the company’s president for Latin America and Canada, said in a statement.The statement was dated June 12 but made public in a filing with the U.S. Securities and Exchange Commission on Tuesday.In July 2009, Philip Morris International agreed to buy privately-held Productora Tabacalera de Colombia, Protabaco, Ltda, Colombia’s second-largest cigarette maker, for $452 million. Philip Morris USA, Altria Group Inc.’s and two other big cigarette companies lost a $20 million verdict in Florida state court in Fort Lauderdale. Last week a jury formed of six persons found Liggett Group, Philip Morris and R.J. Reynolds Tobacco Co. guilty and responsible for the cancer death of Margot Putney, a Lighthouse Point, Florida. She was a woman who began smoking in 1953, when she was 15 and she died in 1995. The woman started smoking when the advertising for cigarettes where everywhere, on TV, radio, print media, newspapers. Charles Baumberger is the lawyer who represented the three kids of Putney. This verdict is following the one that was given in 2006 in Florida, when the tobacco industry had serious losses.
