It’s not your usual tobacco plant
The Marlboro label is familiar, but what’s coming off the production line at a factory near Busch Gardens is not your typical tobacco product. In a former Philip Morris cigarette-equipment repair plant, the nation’s top tobacco company is now making something called Marlboro snus, one of the newer entries in a growing array of alternative tobacco products. Snus — the word rhymes with “juice” — is an oral, but spitless, pouch tobacco. A popular way of consuming tobacco in Sweden for decades, the smokeless product has gained traction in recent years among U.S. cigarette-makers as a way to sell tobacco to smokers in an increasingly smoke-free society. The York County factory itself isn’t a typical tobacco plant, either. “It is something that is new and unique and different from anything else that we have,” Ed Tucker Jr., director of smokeless tobacco manufacturing at the York … Read entire article »

Philip Morris is not to pay $100 million
The Oregon Supreme Court has ruled that Philip Morris the maker of Marlboro cigarettes does not have to pay $100 million in punitive damages to the family of a smoker who sued the tobacco giant over its low-tar cigarettes. The case, however, is going to another jury to decide just how much the death of Michelle Schwarz from lung cancer in 1999 will cost Philip Morris — and legal experts say it could easily be another big award. A Multnomah County jury in Portland originally awarded the Schwarz family $150 million in March 2002 before the trial judge reduced it to $100 million. On Thursday, the Oregon Supreme Court vacated the $100 million award and sent the case back to the trial court to reconsider the punitive damages after ruling the judge failed … Read entire article »

Kentucky wholesaler bought stolen cigarettes
A Kentucky tobacco wholesaler paid $205,000 in 2006 to buy part of a load of stolen Marlboro cigarettes, according to documents filed Monday in federal court in Mississippi. The businessman, Charles H. Wells of Hopkinsville, pleaded guilty in Mississippi recently to fraud charges. He admitted taking part in a scheme to report that cigarettes were sold in Mississippi when in fact he sold them in Kentucky, avoiding a Kentucky tax and escrow fee. But he also was involved in buying stolen cigarettes, a Miami-area man said in pleading guilty Monday. Mitchell Sivina, 38, admitted acting as a broker between people who hijacked truckloads of cigarettes and tobacco wholesalers who bought them. Documents filed in Sivina’s case said thieves stole a load of more then 1,000 cases of Marlboro cigarettes, valued at about $2 million, from … Read entire article »

Philip Morris starts arbitration against Uruguay over taxes
Tobacco giant Philip Morris International (PMI) has initiated an ICSID arbitration against Uruguay over new rules requiring that 80% of cigarette pack surfaces be devoted to graphic warnings of the dangers associated with smoking. Over the last two years the Uruguayan government has engaged in a public health campaign to lower the smoking rates among its population, which was as high as 50%. As part of the anti-smoking campaign the government implemented a series of measures that it claims are directed at protecting public health. Among these is a new rule increasing mandatory graphic warning labels on cigarette packs to 80% of the pack. The company alleges that the labeling requirements and recent tax increase harm its investments and infringe on its trademarks in violation of the Switzerland-Uruguay bilateral investment treaty.
